Plot Twist As Legal Eagle Casts Doubt If Rhb Bank Has Pursued Right Procedures In Axing Hardcore Pas Staff

A HUMAN rights activist and lawyer has defended terminated RHB Kulim Barat branch employee Siti Nurziswanis Mohd Zain on grounds if Malaysia’s fourth-largest financial services group by total assets has complied with the proper procedures prior to terminating the deemed opposition-slant staff.
This includes whether a SHOW CAUSE LETTER had been issued to inform the employee what exactly had she done wrong.
“The employee can choose to answer or not. If she has chosen to answer, then it is to usually deny that there was any breach of contract or that serious misconduct had been committed,” Charles Hector pointed out in a recent blog calling for Siti Nurziswanis to be reinstated following her dismissal with effect from Oct 31.
The second likely procedure is that of a DOMESTIC INQUIRY which is presided by an independent tribunal who will at the end of the day decide whether the employee had committed an employment misconduct.
This came about as oppositionn-slant netizens have called for the boycott of RHB Bank in retaliation to the deemed sacking of staff Siti Nurziswanis who had admitted to having shared a photoshopped image of Prime Minister Datuk Seri Anwar Ibrahim donning an Israeli flag saree on her Facebook Story.

“Or if a breach of contract had occurred – and if yes – the tribunal/panel will recommend sentence, be it a warning, fine, pay cut, freeze on promotion or dismissal,” contended Hector.
“It’s like a trial where the accused employee can also cross-examine the employer’s witness or even bring in his/her own witnesses. The employee rightly and justly can be represented by a lawyer.”
The left Hector who runs a legal practice in Tenerloh, Pahang to wonder if the RHB Banking Group has “over-reacted” or embarked on a “knee-jerk reaction” in the matter.
“Maybe RHB just did not want to get into the bad books of PMX and/or ISRAEL?” suggested the co-founder of NGO Malaysians Against Death Penalty & Torture (MADPET).

Maybe just to share a ‘funny image’ or maybe she disapproves the growing concern about PMX appearing to be more ‘pro-Israel’ following recent events – this matters not only as her right or freedom of expression but a right accorded to all citizens in the Federal Constitution.”
Added Hector:
Our rights and freedoms as a human being cannot and should not be controlled or suppressed by our employers –
“We aren’t ‘slaves’ compelled to do whatever the employer wants us or allows us to do outside our working hours generally.
Likewise, civil servants, too, are free to criticise PMX and his Madani government, support the Opposition or even campaign and vote for the Opposition.” – Focus Malaysia
