Najib S Appeals In Src Case Apex Court To Decide Next Week
The Federal Court will deliver its decision next Wednesday on the four appeals by former prime minister Najib Abdul Razak in relation to his SRC International Sdn Bhd case
The seven-member panel led by Chief Justice Richard Malanjum heard submissions on all four appeals from the prosecution and the defence, yesterday and today
After the submissions ended, Justice Malanjum said the panel would deliver its judgment at 11am on April 10
Previously, the Court of Appeal dismissed three out of the four appeals by Najib, allowing only the appeal for the Attorney-General's Chambers (AGC) to produce the letter of appointment for prosecutor Sulaiman Abdullah
The court had also given the AGC three days to produce the letter of appointment. The AGC did not request for a stay pending its appeal to the Federal Court
Najib's lead counsel Muhammad Shafee Abdullah also filed the appeal against the Court of Appeal's decision on the three dismissals with the Federal Court
Yesterday, the Federal Court was told that the letter of appointment of Sulaiman (above) had been given to the defence but the AGC intends to proceed with the appeal on a matter of principle
The second appeal is for a gag order on media and the public to prevent discussion of the trial
The third appeal is on whether the attorney-general has the constitutional right to withdraw a certificate of transfer after he had tendered the same and caused the case to be transferred to the High Court
The final appeal is on whether the accused is entitled to all witness statements or documents obtained in the course of investigations for the preparation of his defence
As of Feb 8, Najib has been charged with 42 criminal charges. The former BN chairperson and former Umno president has pleaded not guilty to all the charges
He was first charged on July 4 last year on three counts of criminal breach of trust and one count of abuse of power in connection with SRC International Sdn Bhd funds totalling RM42 million
The first day of trial for this case took place on April 3 at the High Court in Kuala Lumpur. The trial has been fixed to continue on April 15. -Mkini
