Pandan MP Rafizi Ramli is keen to carry out a social and legal experiment - can a poor person charged with a petty crime get the same deal as a VIP accused of a major financial crime?
ADSThis is after the prosecution agreed to drop their corruption case against Bersatu leader Adam Radlan Adam Muhammad after he agreed to pay a RM4.1 million compound, which ultimately resulted in his acquittal.
Rafizi (above) said this appeared to show a trend of bias against the poor in the justice system.
"If regular people steal milk, the sentence is six months in jail. If VIP's family members are accused of corruption, theft, and if they can pay it back, then they are let go.
"If, after this, an average person is accused of stealing milk or regular food, please inform me.
"I want to find a lawyer to file the same representation to return the stolen milk and ask for release. We will see if the prosecution and courts will agree," he said in a statement today.
Bersatu leader Adam Radlan Adam MuhammadLast week, prosecutors told the Sessions Court in Kuala Lumpur that it had accepted a representation from Adam when he agreed to pay a RM4.1 million compound.
They then applied for a discharge but no acquittal of all 12 corruption and money laundering charges against him.
However, the defence argued that the Bersatu division leader should be acquitted instead, which the court agreed with.
The RM4.1 million is the amount Adam was accused of receiving.
Corruption charges
Adam was previously charged with one count of soliciting a cash bribe of between 3.5 and seven percent of the value of a project to be awarded by Mat Jusoh Mamat, the managing director of MIE Infrastructure & Energy Sdn Bhd.
He was charged with another count of accepting a bribe of RM500,000 from the same individual as an inducement to help the company secure the same project, which spanned from Jalan Sungai Adam to Kampung Banat in Perlis, from the government through direct negotiations, valued at RM47.8 million.
ADSAdam also faced three charges of receiving bribes totalling RM4.1 million from Lian Tian Chuan and Mat Jusoh as payment for helping Nepturis Sdn Bhd and MIE Infrastructure & Energy secure two Jana Wibawa projects.
Additionally, he was accused of soliciting a bribe of RM2 million from Lian in exchange for assisting Nepturis in obtaining the same projects.
This is on top of money laundering charges against him.
There is a lack of clarity whether the RM500,000 he was charged with receiving is part of the RM4.1 million he had received or an additional amount.
Rafizi, however, quipped that Adam had made a profit as the latter had paid less than what he received.
Under the MACC Act, the punishment for receiving bribes includes a fine of at least five times the amount.
In Adam's case, this would have amounted to at least RM20.5 million if the prosecution were able to prove their case. - Mkini
