Radiant Concord Wins Court Nod To Sue Dbkl Over Shady Malay Reserve Land Deal

The High Court has granted Radiant Concord Sdn Bhd (RC), a Bumiputera developer, the green light to proceed with a judicial review against Dewan Bandaraya Kuala Lumpur (DBKL) over what the company describes as a highly irregular and unlawful transfer of a Development Order (DO) involving Malay Reserve Land.
In its affidavit, RC alleges that DBKL facilitated the illegal transfer of its DO to Muhibah Sekitar Sdn Bhd, executed by Alvin Tee Guan Pian, a non-Malay—despite laws under the National Land Code (NLC) and Malay Reservation Enactment which clearly prohibit non-Malays from executing transfers of Malay Reserve Land. Any such transfer, by law, is void and cannot be registered.
The case also raises serious concerns of misappropriation, as RC claims its RM2.4 million DO deposit was wrongfully used in the transfer, effectively converting RC’s asset into another party’s property—a direct violation of Article 13 of the Federal Constitution, which protects against deprivation of property without lawful authority.
In a major development, the Attorney General’s Chambers (AGC) confirmed in a letter dated 28 January 2025 that it would not oppose RC’s application and would not represent DBKL or the respondents at the next stage. Legal observers view the AGC’s silence as a sign that the claims carry substantial weight and are likely supported by credible evidence.
The scandal doesn’t stop there. The case is expected to probe the role of MBSB Bank, which allegedly financed the illegal transfer. If true, the bank could face exposure to significant legal risk, as it may lose its security over the Malay Reserve Land due to the invalid nature of the transaction.
RC is represented by Elani Mazlan of Rosli Dahlan Saravana Partnership, and the matter has been fixed for case management on 29 April 2025.
The case is expected to spark public outrage over the misuse of Malay Reserve Land, possible misconduct within DBKL, and the role of government-linked entities in enabling such transactions. All eyes will be on the court as the judicial review unfolds, with more explosive revelations likely to emerge.
