(Bernama pic)PETALING JAYA: The lawyer for Sam Ke Ting has urged the people to pray for the clerk after the Johor Bahru High Court sentenced her to six years in jail and fined her RM6,000 for reckless driving that caused the deaths of eight teenagers on modified bicycles, or “basikal lajak”.
Faizal Mokhtar also asked the public to pray for him so that he could present the case well in the Court of Appeal.
“We have had discussions to appeal against the court decision. Hopefully, I can prepare the documents today and file the appeal tomorrow,” he told FMT.
Faizal said Sam was calm and composed following the High Court decision.
Earlier today, Sam, 27, was also ordered to serve another six months in prison if she did not pay the fine and was disqualified from driving for three years, according to Berita Harian.
Sam’s lawyer had asked for a stay of execution since they would be appealing the decision at the Court of Appeal.
But Judge Abu Bakar Katar rejected this and instructed Sam to begin her sentence today.
The sentencing follows the Attorney-General’s Chambers’ appeal against a magistrates’ court’s decision to acquit her for causing the death of the eight cyclists at Jalan Lingkaran Dalam in Johor Bahru at 3.20am on Feb 18, 2017.
The court had acquitted and discharged her at the end of the prosecution’s case without calling for her defence on Oct 28, 2019.
However, the High Court ordered Sam to enter her defence on Feb 18 last year after allowing the prosecution’s appeal.
Sam, who was 22 at the time of the incident, was charged under Section 41 (1) of the Road Transport Act 1987 (Act 333), which carries a maximum jail term of 10 years and a fine of RM20,000, upon conviction.
The eight victims were Azrie Danish Zulkefli, 14 (at the time of the incident); Shahrul Izzwan Azzuraimie, 14; Firdauz Danish Mohd Azhar, 16; Fauzan Halmijan, 13; Azhar Amir, 16; Harith Iskandar Abdullah, 14; Shahrul Nizam Marudin, 14; and Haizad Kasrin, 16. - FMT
