Several notable court proceedings, including cases involving prominent political figures, are set to take place this week. - NSTP/MOHD FADLI HAMZAHKUALA LUMPUR: Several notable court proceedings, including cases involving prominent political figures, are set to take place this week.
Today, the Kuala Lumpur High Court will deliver its decision on the appeal filed by Datuk Seri Najib Razak and his son, Datuk Mohd Nazifuddin, against the same court's ruling that rejected their bid to stay bankruptcy proceedings.
The proceedings were initiated by the Inland Revenue Board after both failed to settle their outstanding tax arrears, amounting to RM1.69 billion and RM37.6 million respectively.
Judicial Commissioner Suhendran Sockanathan @ Saheran Abdullah fixed the date after hearing submissions from counsel Muhammad Farhan Muhammad Shafee, representing Najib and Nazifuddin, while the Inland Revenue Board was represented by Senior Revenue Counsel Norhisham Ahmad.
On Oct 16, 2023, the Federal Court ruled that both father and son must pay their tax arrears after dismissing their appeal to overturn the High Court's decision.
In September 2021, the Court of Appeal dismissed their bid to set aside the judgment, before the Federal Court granted leave for them to proceed with the appeal at the top court on May 20, 2022.
Meanwhile in Sabah, the Kota Kinabalu Sessions Court will hear and decide on a suit against Sabah Chief Minister Datuk Seri Hajiji Noor, who is accused of contempt of court.
The application was filed by whistleblower and businessman Datuk Albert Tei following claims that Hajiji had instructed the Sabah Immigration Department to bar him from entering the state.
Taking place today is a case management to fix an early hearing date for the compensation assessment involving Semantan Estate Sdn Bhd (SESB).
On June 24, the Court of Appeal ruled that SESB was not entitled to ownership of the land but was eligible for reasonable compensation to be assessed based on the land value in 1956, when it was acquired by the government.
The land, located in the prime Jalan Duta area, houses, among others, the Inland Revenue Board complex, several government buildings, the National Hockey Stadium, the Institute of Islamic Understanding Malaysia, and the Federal Territory Mosque.
Tomorrow, the Kuala Lumpur High Court will hear former prime minister Tan Sri Muhyiddin Yassin's application for the temporary release of his passport to travel abroad.
In May last year, the Kuala Lumpur Sessions Court allowed Muhyiddin's request for temporary release of his international passport to enable him to visit his sister, who was undergoing cancer treatment in Australia. - NST
