Azalina Macc Submits Probe Report On Judge Nazlan To Cj
PARLIAMENT | MACC has submitted a report to Chief Justice Tengku Maimun Tuan Mat regarding its investigation of Court of Appeal Judge Mohd Nazlan Mohd Ghazali.
“I was informed by the MACC, through a letter on Feb 21, that a report against Nazlan (above) was submitted on the same date to the chief justice in relation to violations under the Judges’ Code of Ethics 2009,” said Minister in the Prime Minister’s Department (Law and Institutional Reform) Azalina Othman Said.
The minister told Dewan Rakyat today that no other information regarding the matter was revealed to her in the letter.
She stated that it is now subject to the decision of the chief justice, in accordance with Article 125 (clauses 3 and 3A) of the Federal Constitution.
Article 125(3) of the Federal Constitution provides the chief justice (with consultation from the prime minister) the authority to propose to the Yang di-Pertuan Agong the creation of a tribunal to dismiss a judge from their position. This article does not offer any alternative options.
As for Article 125(3A), in the event that a judge violates the code of ethics under clause (3b), but the chief justice deems the violation to not require referral to a tribunal established under clause (4), the chief justice may instead refer the judge to a federal body designated to handle such violations.
Minister in the Prime Minister’s Department (Law and Institutional Reform) Azalina Othman SaidHowever, Azalina emphasised that the government will not interfere with the powers of the chief justice and attorney-general and will leave it to them to decide the course of action on Nazlan.
In September, MACC confirmed that the investigation paper involving Nazlan has been completed - where chief commissioner Azam Baki said the commission was awaiting further instructions from the Attorney-General’s Chambers (AGC).
MACC initiated an investigation into Nazlan on Apr 23, 2022, after receiving a report from Persatuan Sahabat Ulul Amri Malaysia (PSUAM).
