Warisan Preparing To Sue 10 Reps For Contract Breach

(Facebook pic)PETALING JAYA: Warisan is preparing to sue 10 assemblymen who left the party last year for breach of contract, says party president Shafie Apdal.
Shafie said the decision to file lawsuits against them followed the Kuala Lumpur High Court’s recent judgment against former PKR vice-president Zuraida Kamaruddin, who joined Bersatu following the Sheraton Move in late February 2020.
The former Ampang MP was ordered to pay PKR RM10 million in damages for breaching a bond she had signed six years ago by joining Bersatu.
The court said under the terms of the bond, Zuraida had promised to pay RM10 million in any of three events, including if PKR terminated her membership or if she resigned.
Before contesting the 2020 Sabah state election, the 10 assemblymen had agreed to vacate their seats in the event they left the party after winning.
“These assemblymen breached their contract with Warisan the moment they left the party,” Shafie was quoted as saying by The Borneo Post.
“The defectors should also be liable to pay the costs incurred by Warisan for financing their campaigns.
“Malaysia has a democratic system of law. In a democracy, the judiciary is impartial and objective.”
The 10 Warisan assemblymen who left the party were Yusof Yacob (Sindumin), Mohamaddin Ketapi (Segama), Peter Anthony (Melalap), Juil Nuatim (Limbahau), Rina Jainal (Kukusan), Awang Ahmad Sah Sahari (Petagas), Norazlinah Arif (Kunak), Mohammad Mohamarin (Banggi), Ben Chong (Tanjung Kapor) and George Hiew (Karamunting).
Last July, judge Wong Siong Tung struck out Warisan’s suit to declare the Sebatik seat vacant after its incumbent, Hassan A Gani Pg Amir, quit the party in 2021.
Wong ruled that an elected assemblyman should be free to act according to the best of his ability and that his judgment should not be legally constrained by obligations to his party. - FMT
