Family Advised To Claim Against No Show Caterer Through Consumer Tribunal
It can be costly to file a civil suit. Instead, members of the public can turn to the Tribunal for Consumer Claims for any claims below RM50,000. (Facebook pic)PETALING JAYA: A family which had to prepare food for guests of a wedding reception themselves after the caterer they hired failed to turn up can file a claim with the Tribunal for Consumer Claims (TTPM).
A former deputy chairman of the tribunal said the aggrieved party needed to attach proof of booking and any payment made to the caterer.
“They can also attach any police report made, arising from the non-appearance of the caterer,” he told FMT on condition of anonymity.
He said at this stage, there was no need to file a civil suit as the legal fees could be costly.
A consumer can file a claim with the tribunal if the total amount being claimed does not exceed RM50,000, and it must be done within three years.
The claim can be filed at any tribunal counter in the country or through online filing. This will only cost RM5.
On Dec 25, Bernama reported that Burhanuddin Rabbani Abdul Shukor, the bride’s brother, had posted on Facebook that the caterer was supposed to prepare food for 1,000 guests and also arrange the wedding dais.
Due to the caterer’s no-show, he said the family suffered losses amounting to RM13,200.
The wedding went ahead at the Serting Junior Science College hall in Jempol, Negeri Sembilan.
“Just to let everyone know, we were conned. The caterer we hired didn’t show up. We called repeatedly but there was no response.
“We ended up cooking the food ourselves. We could only prepare food for around 400 people, just simple curry chicken, sambal belacan, fruits and fresh vegetables,” he said.
A police report was made at the Bandar Seri Jempol police station the night before the wedding.
Jempol district police chief Hoo Chang Hook later said the case was being investigated under Section 420 of the Penal Code for cheating. - FMT
