Aziz Bari Confidence Vote Is Close To Spirit Of The Constitution
It is important to hold a vote of confidence for Prime Minister Ismail Sabri Yaakob at the Dewan Rakyat in the spirit of the Federal Constitution, said constitutional expert Abdul Aziz Bari.
According to the Perak DAP vice-chairperson, it is a practice or tradition that should be continued.
"Although the practice is not expressly mentioned by the constitution, it is also not prohibited by any constitutional provision. And more importantly, it is close to the spirit of the constitution.
“It is especially important in a situation where there is a slim and questionable majority.
“With that, the Yang di-Pertuan Agong decreed that the vote of confidence should be continued," Aziz (above) said in a statement today, commenting on the country’s political situation after Ismail Sabri was appointed the ninth prime minister.
The king previously decreed that whoever was appointed as prime minister following Muhyiddin Yassin’s resignation should seek a vote of confidence.

Meanwhile, Aziz, who is a former law lecturer, said it was quite evident so far that all parties had agreed that a motion of confidence was necessary to confirm Ismail Sabri’s appointment in the middle of the term.
He said the current situation is different from Agong’s appointment of the government after a general election.
“It has been a consistent practice in Malaysia, starting with Hussein Onn in 1976, followed by Abdullah Ahmad Badawi in 2003 and Saarani Mohamad (Perak MB) in Perak in 2020. All these appointments were then followed by a motion of confidence in the dewan.
“It should be noted that in 1976 and 2003 the ruling party had a two-thirds majority in the Dewan Rakyat.
"The transition of power from Tunku Abdul Rahman to Tun Abdul Razak in 1970 and Hussein Onn to Dr Mahathir Mohamad in 1981 was not followed by a motion of confidence. However, these two are minority cases," he explained.
The Tebing Tinggi state assemblyperson added that when Umno was banned by the court in 1987, Mahathir, as prime minister of the time, proved his majority outside Parliament.
"Besides, more recent practices in 2003 and 2020 are in favour of such a proposal," Aziz said. - Mkini
