Yusuf Rawther Case Some Advise To Senior Civil Servants


 My apologies folks on such a big day. I was out the whole day since early morning and just got home after 6 PM. 
First of all congratulations to Yusuf Rawther, his family and his lawyer Rafique over the acquittal. Not only Yusuf Rawther and his family but the whole country was holding its collective breath over this obvious cock-up of a case.  We will look at the Judges decision shortly.
The YouTuber Jebat Derhaka advises Yusoff to be extra careful with your personal safety until the legal suits are settled. Jebat even suggests that Yusoff Rawther move into a safe house. You can listen to Jebat Derhaka here.
I hope Yusoff Rawther will sue the gomen over the NINE MONTHS suffered in prison and seek multi-million Ringgits in damages. And include individual office bearers in your suit - as also liable for negligence. In other words demand that they be personally liable as well. More importantly make their lives miserable. Drag them to Court for a change.

12 June 2025, KL High Court acquitted Muhammed Yusoff Rawther, the former research assistant to (‿ˠ‿) of two serious criminal charges involving drug trafficking and possession of imitation firearms. 
The court ruled prosecution failed to establish a prima facie case, resulting in Yusoff’s full acquittal without requiring him to enter a defence. The decision brings to a close a high-profile criminal case that had drawn national attention, though it does not affect the separate civil lawsuit Yusoff has filed for alleged sexual misconduct.

The case centred on the discovery of approximately 300 grams of cannabis and two imitation pistols found inside Yusoff’s car in August 2023. Prosecutors charged him with drug trafficking under Section 39B(1)(a) of the Dangerous Drugs Act 1952, a provision that carries the mandatory death penalty upon conviction, as well as possession of imitation firearms under the Firearms (Increased Penalties) Act. Yusoff, who was 32 at the time of his arrest, pleaded not guilty and maintained his innocence throughout the proceedings.

In delivering the verdict, High Court Judge Datuk Muhammad Jamil Hussin found that the prosecution had failed to present sufficient evidence to prove that Yusoff had knowledge or control over the illegal items. Although the car where the contraband was found was registered in Yusoff’s name, the court noted that this alone was not enough to prove possession beyond a reasonable doubt. The judge emphasised that the prosecution was unable to establish a direct link between Yusoff and the cannabis or imitation firearms, and thus failed to prove the essential elements required to proceed with a full trial.

The acquittal was widely covered in Malaysian media, with outlets such as Malay Mail, The Edge, The Star, and Malaysiakini reporting on the ruling. Malay Mail underscored the court’s finding that the prosecution had failed to establish a prima facie case. The Edge noted the court’s careful consideration of the ownership of the vehicle and the absence of conclusive evidence tying Yusoff to the contraband. The Star and Malaysiakini both echoed the legal significance of the judge’s decision to acquit and discharge Yusoff without requiring him to present a defence, highlighting the strength of the presumption of innocence in Malaysian law.

Despite the criminal charges being dropped, Yusoff Rawther remains entangled in legal proceedings due to his civil lawsuit against (‿ˠ‿). While the criminal complaint initially filed with the police did not result in prosecution—due to what the Attorney-General’s Chambers described as insufficient evidence—the civil case proceeded independently through Malaysia’s judicial system.

In 2022, the Kuala Lumpur High Court stayed the civil trial pending a decision by the Court of Appeal on whether the case should be struck out. As of June 2025, the matter remains unresolved, with a final decision expected from the Federal Court in the coming months. The outcome of that case could have significant political and legal implications, not only for Yusoff but also for (‿ˠ‿) who has been dogged by past allegations of misconduct.

The acquittal of Yusoff Rawther in the criminal case represents a significant development in a complex and politically charged saga. It removes the immediate threat of capital punishment and lengthy imprisonment, but the legal battles are far from over. Yusoff’s civil action continues to move slowly through the courts, underscoring the challenges faced by individuals pursuing allegations against high-ranking officials.

For now, the High Court’s decision offers Yusoff a reprieve and a measure of legal vindication in the face of extremely serious criminal accusations. Whether the same will hold true in the separate civil case remains to be seen.

The question that still remains in the public mind: who instructed the p___ce to frame him?

My Comments:
The case was a non-starter. The judge said that nothing was proven against Yusoff Rawther. There was no evidence that he was in possession of those items, there was no evidence of Yusoff even being in the car with the illegal items.
The illegal items were not dusted for fingerprints and hence there was no evidence of Yusoff's fingerprints on the illegal items.
Then there were those really silly and amateurish facts about how they opened the car doors - without using the keys and from the co-driver's side which had no 'lubang kunci'. Chegubard has gone to town with this 'tak ada lubang kunci' (Click here, scroll to minute 15).
"The prosecution had failed to prove that Yusoff had any knowledge, custody, and control of the drugs and fake pistols. This leads to the hypothesis that these items were planted by someone else in Yusoff’s car".  
The defence was not even called. The Judge just dismissed the case. The question is despite such low grade or low quality evidence how did this case pass the Police investigations? And then how did the Attorney General recommend this case to be prosecuted in the Court? This case has turned out to be a waste of public funds, a waste of valuable manpower (in the Police and at the AG's Chambers) and a waste of the Court's valuable time. Both the IGP and the AG should explain to the public how did you allow such a case to get through your vetting so easily. Yes I know there are previous cases too which have been dismissed without the defence being called but the Judges comments over this case are really quite dismissive.  So obviously someone must have planted the drugs and the toy pistols in Yusoff Rawther's car. The Court has found that it was not Yusoff. So it has to be someone else.
In Malaysia who has access to drugs like cannabis? Who has access to toy pistols or real pistols? Who has the skills to open car doors without the key?  
MY ADVISE TO THE TOP CIVIL SERVANTS
Here is my advise to the Top Civil Servants. When the sun never set on UMNO/BN, when UMNO BN ruled the country from 1955 until 2008 (53 years until UMNO lost the 2/3 majority in Parliament) those were the good times to be top Civil Servants. After top Civil Servants retired they could look forward to being appointed Chairman of some lucrative gomen agency, gomen owned company or be invited to be Chairman of public listed companies. Two good examples were Tan Sri Hashim Aman who became Chairman of Maybank. The other person was Tun Haniff Omar the former IGP who became Chairman of Genting Bhd. Both of them had well respected roles and they built up a very good reputation. Tan Sri Hashim Aman was a Civil Servant par excellence.
But not after 2008. UMNO lost serious political power in 2008 and got fully kicked out in 2018. And after 2008 the top Civil Servants started suffering collateral damage from working for prime ministers who were basically crooks and thieves. They became victims of the Law of Unintended Consequences. They never intended for things to go this way or that way but when you hang out with unscrupulous prime ministers, things can really go sideways. And you cannot avoid being identified with their shenanigans.
During Bossku the KSN was tasked with firing some honest people. Although he was just doing his job he got the bad Press as well. After he retired no one wanted to be seen with him. He left the country and died soon after.  That midget AG would have certainly been prosecuted if not for his super legal immunity. But AGs should not be free from criminal negligence.  
After Bossku I believe none of the KSNs, IGPs, AGs or BN governors have been appointed to any chairmanships post retirement. This is also because none of the PMs have survided a full term and none of their gomen lasted a full term. This is going to the trend in this country for a while. So when a gomen changes who wants to be identified with any ex Civil Servant who had worked for the previous PMs?  They become toxic waste. 
And the day will come when the gomen changes they may hold ex Civil Servants legally liable for what they had done under a different prime minister.  They can always find chinks and cracks in that wall of immunity. 
So Civil Servants do take note. 
p.s. That Pastor Koh and Amri Che Mat cases (plus the others) are not over yet. Mark my words. Or Wang Kelian. All it takes is for the right gomen or the right amount of pressure from the public  and it can start to snow on Gunung Besar Hantu.
