Pn Keeps Gua Musang After Apex Court Bins Bn S Appeal
Perikatan Nasional's Mohd Azizi Abu Naim remains Gua Musang MP after the Federal Court dismissed an election petition appeal by BN.
A three-person Federal Court bench chaired by Court of Appeal president Amar Abang Iskandar Abang Hashim unanimously denied an appeal filed by Mohd Azmi Mahmood.
The other bench member judges are Rhodzariah Bujang and Abu Bakar Jais.
The court also ordered Azmi to pay RM30,000 in costs to Azizi.
Gua Musang MP Mohd Azizi Abu NaimOn Sept 5, the Kota Bharu Election Court struck out BN's election petition for Gua Musang, following the firing of Azmi’s legal team.
It was reported that Azmi filed the petition to nullify the 15th general election results for the Gua Musang parliamentary seat which was won by Bersatu's Azizi, who defeated BN's Tengku Razaleigh Hamzah by a majority of 1,826 votes.
The court today allowed a preliminary objection by Azizi’s counsel Yusfarizal Yussoff against Azmi’s appeal.
Yusfarizal said the matter today was unsuitable for appeal as Azmi could always file an application before the Kota Bharu Election Court to reinstate the election petition.
The lawyer explained to the bench that when Azmi fired his legal team, the petitioner was not present before the Election Court on Sept 5, leading to judge Amarjeet Singh striking out the election petition.
Despite today’s Federal Court ruling, Azmi can still file an application before the Election Court to reinstate his legal challenge over PN’s electoral victory in Gua Musang.
