Muhyiddin Could Lose Pagoh Seat If Found Guilty Says Lawyer
The police need to investigate and consider several aspects first to find out if he have violated any of the three provisions under the Penal Code or the Sedition Act.
(Sinar Daily) – The Pagoh Member of Parliament seat held by Tan Sri Muhyiddin Yassin may be forfeited if he is found to have violated any of the three provisions under the Penal Code or the Sedition Act.
Following this, lawyer Mohamed Haniff Khatri Abdulla said that the police needed to investigate and consider the following aspects first.
“First, the police need to investigate whether the statements made are false or not.
“Second, the question of whether the statement was intended to undermine the credibility of the royal system was also considered.
“Third, whether it is viewed as a professional opinion by those in the relevant field or as Muhyiddin’s personal view without the intent to distort facts,” he said when contacted by Sinar Harian on Monday.
Elaborating further, Haniff said that if the police found grounds for further investigation, they would submit the investigation papers to the prosecutor’s office.
“Subsequently, if the prosecutor’s office finds sufficient grounds for charges to be brought in court, it will proceed with the charges.
“If the court finds him guilty, it could affect his position as a Member of Parliament.
“If the penalty exceeds RM2,000 or imprisonment of more than a year, the representative will lose his membership based on the constitution under Article 48 Clause 1,” he added.
