Why choose fatwa over civil laws? UN committee asks Putrajaya

KL Feb 21 — The Malaysian government should state the legality of Islamic edicts or fatwas and why they take precedence over civil laws despite not being legally binding, a United Nations (UN) committee has said.
The question was posed by Ruth Halperin-Kaddari, the vice-chair of the United Nations Convention on the Elimination of all Forms of Discrimination Against Women (CEDAW) committee in Geneva, Switzerland yesterday during a review of Malaysia’s progress on women’s rights which was broadcast live.
The committee had referred to the National Registration Department’s (NRD) refusal to allow Muslim children born within six months of their parents’ marriage, to take their father’s names and instead using the “bin Abdullah” suffix often associated with illegitimate children.
It pointed out that if the child cannot take the father’s name, it would also mean that she may not be conferred with Malaysian nationality — thus contravening Article 9 of CEDAW that regulates equal rights on nationality.
“Why does the government not abide by the state laws that obligates the registration of every child upon birth, and conferring nationality, when it is a Malaysian man [who is the father]?
“And why does the government with administrative powers over the national registration department, prefer the religious fatwa rather than the civil law?” Halperin-Kaddari asked.
She also questioned the Malaysian delegation if the situation would change following the landmark Federal Court’s verdict in the M. Indira Gandhi case, which ruled that the civil courts still hold the final say, even in matters concerning Islamic laws.
Halperin-Kaddari then pointed out that issues pertaining to children’s nationality and birth registration is therefore “obviously a constitutional issue”.
Arik Sanusi Yeop Johari from the Attorney-General’s Chambers however said that the team was unable to deliberate or explain the matter, claiming subjudice as the “bin Abdullah” case is currently pending in the Federal Court.
Halperin-Kaddari then again pressed the delegation to answer as a mere matter of “principle”, the possibility of challenging a religious edict by way of a judicial review.
However, Arik maintained his initial reply, which frustrated another committee member who then questioned the Malaysian delegation on the actual position of Malaysia — whether it is a secular or theocratic nation.
“Malaysia is supposed to be a republican state. Not a theocratic state, and it must be made very clear that laws of the state prevail over religious laws,” Philippine representative and rapporteur, Rosario G. Manalo said, lamenting that Arik’s reply was not acceptable.
“If it’s a theocratic state, that’s the end of a democratic state, but it claims to be a republic. Therefore the state law prevails. So give me a clear answer, otherwise I put you in doubt,” she added.
Malaysia is a constitutional monarchy state.
The committee had earlier also questioned a fatwa against women’s rights group Sisters in Islam, asking whether it is in line with Putrajaya’s obligation to provide for peaceful and pluralist public spheres.
The group had filed in 2014 for judicial review of a gazetted fatwa in Selangor that declared the group as “deviants” in Islam due to their alleged religious liberalism and pluralism.
In Muslim jurisprudence, a fatwa only stands as an opinion of a learned scholar. However in Malaysia a fatwa issued by a state mufti will be made law if gazetted.
On the federal level, the muftis also join a conference of the National Islamic Council’s fatwa committee that would formulate binding fatwa.
Countries party to CEDAW are obliged to send regular status reports on the implementation of the treaty, to be reviewed by a committee of experts which will engage in dialogue with government representatives.
Malaysia’s progress in women’s rights was reviewed only for the second time today, despite acceding to CEDAW in 1995. The last review was 12 years ago for its 2004 report.
My Comments :
First of all, kalau wakil Malaysia ke mesyuarat Yunaited Nesyen di Geneva, Switzerland tidak boleh jawab soalan, tak tahu nak jawab atau tak mahu jawab soalan, tak payahlah pergi ke Yunaited Nesyen pun.
Why waste our duit rakyat? Buang tambang kapalterbang saja-lah, buang api, buang gaji (duit rakyat) to go all the way to Geneva in Switzerland just to say 'the team was unable to deliberate or explain the matter
Kalau unable to deliberate or explain then jawab dengan guna WhatsApp saja-lah.
Why go all the way to Geneva, Switzerland and then to say in front of the whole world 'Saya tak boleh jawab soalan itu' - it is not clever at all. Macam bebudak kampong saja-lah. Malukan negara.
Anyway saya ada dua cadangan dan sedikit analisa
1. First of all, stop going to these international conferences and making a real fool of yourselves.
Malaysia sekarang sudah masuk ke dalam gua entah mana. Negara kita sudah huru hara. Ibu yang kandung dan melahirkan anak-nya dilarang (ikut kuasa paksa pihak berkuasa agama) daripada menemui anak-anaknya. Sebaliknya lelaki yang bukan muhrim dan tiada sebarang kaitan dengan masalah keluarga mereka pula boleh makan satay dengan dua anak perempuan si-ibu.
What type of psycho system is that?
Mengikut semua fahaman hidup yang lain (seperti di-timbulkan oleh mesyuarat United Nations di Geneva itu) this type of dysfunctional behaviours are not normal and does not meet the usual understanding of civilised behaviour. This includes those questions about the 'Abdullah Club' and those questions about democracy versus theocracy.
Jadi tak payahlah Attorney General's Chambers atau siapa-siapa pun mewakili negara kita ke mesyuarat-messyuarat antarabangsa di mana fahaman dan falsafah hidup mereka adalah sangat berlainan daripada fahaman 'duduk dalam gua' kita.
Why waste time and money going to the Yunaited Nesyen conferences? Mereka percaya kepada kebebasan beragama, bebas daripada agama, demokrasi tulen, freedom, human rights, hak wanita, hak kanak-kanak dan banyak lagi.
Ostard punya fahaman pula boleh jauh berbeza. Ikut fahaman ostard anak yang lahir daripada ibu dan ayah biologi (biological parents) tidak boleh dibinkan nama ayahnya jika anak itu lahir awal pula !!
Pada tahun 2021 Curtis Means dari Alabama, USA menjadi anak kandung 'youngest premature baby'. Curtis Means dilahirkan setelah hanya 132 hari dalam kandungan ibunya (EMPAT bulan 12 hari sahaja).
Curtis Means : World Record For Premature Birth Goes To Alabama Baby Born 19 Weeks Early. Curtis Means, now 16 months old, was awarded the Guinness World Record for youngest surviving premature birth, after only 132 days of gestation.
Tetapi ikut kepala otak ostard pula Curtis Means adalah anak haram. Jadi ini fahaman ostard.
So dont ask silly questions ok? Just do like the soldiers "Dont ask why, just do and die".
Jadi jangan buang masa dan buang duit rakyat, jangan buang duit tambang kapalterbang untuk pergi ke mesyuarat Yunaited Nesyen untuk beritahu mereka 'I cannot answer your questions'.
Duduk di rumah saja, bawah tempurung ke, duduk dalam gua ke.
Serupa Malaysia tarik diri keluar daripada PISA dulu - Tuan-Tuan masih ingat tak? (PISA maksudnya Programme for International Student Assessment).
Bila bebudak sekolah kita fail 'PISA rankings' kita ambil cara mudah - Malaysia keluar daripada PISA. Hooray !! Problem solved. Tak payah buang duit, buang api, buang air, buang sewa, buang tambang kapalterbang hadiri mesyuarat PISA dsbnya.
2. Cadangan saya yang nombor dua ialah wakil Attorney General Chamber itu patut tepuk meja saja dan tinggikan suara. Serupa style ostard marah. Just bang the table and shout at the Yunaited Nesyen.
"This is our fatwa. This is how we do things in Malaysia. Who are you to question our fatwa? In Malaysia if you question the official fatwa you can kena masuk penjara three years, you can kena denda RM5000 and/or you can kena 6 kali sebatan rotan'. This is our fahaman in Malaysia. Who are you to question our fahaman?"
Tepuk meja sahaja.
Tunjuk saja jari penunjuk.
Atau tunjuk saja penumbuk.
Problem solved.
3. Awasi kes 'bin Abdullah' kahwin 'binti bapak biologi'.
Yang berikut adalah Surah 33:5 (al Ahzab ayat no. 5)
Yang berikut adalah terjemahan bahasa Melayu diikuti oleh LAPAN terjemahan dalam bahasa Inggeris.
Panggilah anak-anak angkat itu dengan ber"bin"kan kepada bapa-bapa mereka sendiri; cara itulah yang lebih adil di sisi Allah. Dalam pada itu, jika kamu tidak mengetahui bapa-bapa mereka, maka panggilah mereka sebagai saudara-saudara kamu yang seagama dan sebagai "maula-maula" kamu. Dan kamu pula tidak dikira berdosa dalam perkara yang kamu tersilap melakukannya, tetapi (yang dikira berdosa itu ialah perbuatan) yang disengajakan oleh hati kamu melakukannya. Dan (ingatlah Allah Maha Pengampun, lagi Maha Mengasihani. (Al-Ahzaab 33:5)
Khalifa - You shall give your adopted children names that preserve their relationship to their genetic parents. This is more equitable in the sight of Allah. If you do not know their parents, then, as your brethren in religion, you shall treat them as members of your family. You do not commit a sin if you make a mistake in this respect; you are responsible for your purposeful intentions. Allah is Forgiver, Most Merciful.
Mohammad Shaikh - Call them to their fathers, it is more just/equitable at Allah, so if you did not/do not know their fathers so (they are) your brothers in the religion, and your allies/friends , and an offense/guilt/sin is not on you in what you mistook/erred with it, and but what your hearts/minds made intentionally/purposely, and God was/is a forgiver , merciful.
Yusuf Ali Call them by (the names of) their fathers: that is juster in the sight of Allah. But if ye know not their father's (names, call them) your Brothers in faith, or your maulas. But there is no blame on you if ye make a mistake therein: (what counts is) the intention of your hearts: and Allah is Oft-Returning, Most Merciful.
Pickthal Proclaim their real parentage. That will be more equitable in the sight of Allah. And if ye know not their fathers, then (they are) your brethren in the faith, and your clients. And there is no sin for you in the mistakes that ye make unintentionally, but what your hearts purpose (that will be a sin for you). Allah is ever Forgiving, Merciful.
Arberry Call them after their true fathers; that is more equitable in the sight of Allah. If you know not who their fathers were, then they are your brothers in religion, and your clients. There is no fault in you if you make mistakes, but only in what your hearts premeditate. God is All-forgiving, All-compassionate.
Shakir Assert their relationship to their fathers; this is more equitable with Allah; but if you do not know their fathers, then they are your brethren in faith and your friends; and there is no blame on you concerning that in which you made a mistake, but (concerning) that which your hearts do purposely (blame may rest on you), and Allah is Forgiving, Merciful.
Sarwar Call them sons of their own fathers. It is more just in the eyes of Allah. If you do not know their fathers, they are your brothers and friends in religion. You will not be responsible for your mistakes, but you will be responsible for what you do intentionally. God is All-forgiving and All-merciful.
H/K/Saheeh Call them by [the names of] their fathers; it is more just in the sight of Allah. But if you do not know their fathers then they are [still] your brothers in religion and those entrusted to you. And there is no blame upon you for that in which you have erred but [only for] what your hearts intended. And ever is Allah Forgiving and Merciful.
Ikut Surah 33:5, pilihan terbaik ialah nama seorang anak angkat itu perlu ikut nama bapak kandung mereka - genetic father atau biological father.
Ayat ini tidak sebut status kelahiran anak angkat itu. Tidak ada disebut jika anak angkat itu lahir dalam nikah, lahir di luar nikah, lahir ikut cukup tempoh sembilan bulan atau lahir premature EMPAT BULAN 12 HARI seperti Curtis Means di Alabama tadi. Atau nama dia patut ikut 'bin Abdullah'.
Semua itu tidak di sebut dalam ayat ini.
Tetapi tujuan untuk preserve atau mengikuti nama original bapak genetik itu mempunyai sebab-musabab yang scientific dan lebih practical.
So that semua orang akan kenali bapak kandung atau genetic father anak angkat itu.
Ini juga akan membantu mengelak anak angkat itu terkahwin (sebagai contoh sahaja) dengan adik perempuan dia sendiri di masa depan.
Lets say bapak original-nya atau ibu kandung-nya kahwin semula di kampong lain atau di daerah lain dan melahirkan anak perempuan baru. Dan anak angkat itu tidak mengenali anak perempuan itu sebagai anak ibu kandungnya atau bapak genetic nya sendiri maka boleh berlaku kes 'bin Abdullah' terkahwin 'binti bapak sendiri'. Adik beradik biologi (biological siblings) terkahwin. Akan terjadi kahwin sumbang mahram atau incest.
Jadi ikut Surah Ahzab ayat no. 5 ini bagi seorang anak angkat ianya lebih baik untuk mengikuti nama original bapak genetik mereka.
Akhir kalam - Lidah orang Jepun susah juga nak sebut huruf 'L'. Bahasa Jepun langsung tidak menggunakan bunyi 'L'. Jadi apabila mereka sebut 'L' bunyi dia jadi 'R' pula.
Contohnya 'Allahu Akbar' boleh jadi 'ar-rahu akbar'.
Bin Abdullah boleh jadi 'bin abdurrah'.
