Mavcom Settles Suits With Airasia Airasia X Over Rm2m Fines

The Malaysian Aviation Commission (Mavcom), together with local budget airline AirAsia Bhd and its sister long-haul carrier AirAsia X Bhd, has settled two suits that sought to compel both companies to pay RM2 million fines each.
On Sept 14, before two separate Kuala Lumpur High Courts, the parties recorded consent judgments in the matter, entailing Airasia and Airasia X each to pay the RM2 million fines in 18 instalments.
According to copies of the draft consent judgments sighted by Malaysiakini this afternoon, Airasia and Airasia X will each pay the first instalment of RM113,000 on Oct 15 this year, and will pay the final instalment of RM111,000 on March 15, 2022.
The consent ruling involving Airasia was recorded before judge Quay Chew Soon while the one involving AirAsia X was recorded before judge Rozana Ali Yusoff.
Both draft consent judgments were filed at the Kuala Lumpur High Court on Sept 15, a day after the judgments were recorded.
According to court documents, law firm Messrs Azrul Afifi & Azuan appeared for Mavcom while Messrs Zul Rafique & Partners acted for both Airasia and Airasia X.
On July 24, Malaysiakini reported that Mavcom filed two separate suits to enforce the RM2 million fines over Airasia and Airasia X's alleged breach of the Malaysian Aviation Consumer Protection Code 2016 (MACPC). 
On Jan 20, it was reported that Mavcom meted out the financial penalties on AirAsia and AirAsia X over how both the airlines allegedly continued to charge credit card, debit card, and online banking processing fees which were separate from their base fares - in contravention of the MACPC.
When contacted by Malaysiakini today, Mavcom’s counsel Afifi Ahmad confirmed that parties have recorded the consent judgments on Sept 14.
On April 21, Malaysiakini reported that Airasia had filed a judicial review leave application to challenge the RM2 million fine against it.
Airasia X also filed a separate legal action challenging the RM2 million fine against it.
However, on July 27, the Kuala Lumpur High Court dismissed the judicial review leave applications by Airasia and Airasia X.  - Mkini
