Kuala Terengganu Mp Fails To Strike Out Bn Challenger S Polls Petition
PAS’ Amzad Hashim Mohamed (left) is facing a challenge to his Kuala Terengganu parliamentary seat from losing BN candidate Zubir Embong.PETALING JAYA: An election judge has dismissed a preliminary objection brought by Kuala Terengganu MP Amzad Hashim Mohamed to an election petition filed by losing Barisan Nasional candidate Zubir Embong.
Justice Firuz Jaffril, who has been appointed to hear the dispute in Kuala Terengganu, said Amzad’s striking out application was without basis.
“I disagree with the preliminary objections raised. The matter should go to trial,” he said.
Amzad had claimed the petition had been filed out of time and Zubir had failed to plead material facts in the document.
The second term PAS MP also said a notice of appointment of solicitors which Zubir filed had not been stamped and that the service of the petition on him by a chambering student from Messrs Hafarizam Wan & Aisha Mubarak was bad.
Having rejected the objections raised, Firuz went on to fix April 4 to hear the petition and instructed both parties to file all witness statements by March 27.
Zubir filed the petition at the beginning of this year alleging that the PAS candidate or the party’s election workers had bribed voters.
Amzad retained the seat for PAS with a 40,907-vote majority in the 15th general election held on Nov 19 last year.
Lawyers Hafarizam Harun, Baharudeen Mohamed Ariff, Norhazira Abu Hayan and Amin Othman represented Zubir.
Amzad was represented by Saiffuddin Othman, Wan Rohaimi Wan Daud, Nasir Embong and Azrul Rizal Ibrahim. - FMT
