Individuals Linked To Chin Peng S Ashes Will Not Face Charges Minister


 


Individuals who were linked to bringing in the ashes of former Communist Party of Malaya (CPM) leader Chin Peng into the country will not be charged.
Home Minister Hamzah Zainuddin said the case has been classified as "no further action" (NFA) due to lack of evidence.
"There were 11 police reports lodged over the return of Chin Peng's ashes to Malaysia.
"The investigation paper was referred to the Attorney-General's Chambers by the police on June 4, but the decision was NFA due to insufficient evidence.
"However, shall there be any latest development on the case, the government will review the case for further action and refer it to the AG's Chambers," Hamzah said in a parliamentary written reply dated Nov 9 to a question by Abdul Azeez Rahim (BN-Baling).

The police probed the case under Section 504 and Section 505(c) of Penal Code as well as Section 233 of the Communications and Multimedia Act 1998.
Chin Peng – whose birth name is Ong Boon Hua – died in Thailand in 2013 at the age of 89.
He had fought a nine-year legal battle to be allowed back in Malaysia but lost as the Federal Court, on April 30, 2009, ruled against his application to reside in the country because he was unable to prove that he was born in the country.
On Nov 26, 2019, Malaysiakini reported that Chin Peng's ashes were brought back from Thailand on Sept 16, 2019, six years after his death. His ashes were scattered in the sea near Lumut, Perak, as well as in the jungles of the Titiwangsa mountain range two months later. 
The next day, the police said they have opened an investigation paper on this matter. 
The police then took statements from the complainants, a Malaysiakini editor, a reporter, the person who brought the ashes as well as individuals involved in the ceremony in Perak.
Hamzah pointed out that the police would not hesitate to take stern action against those who try to cause chaos and create any form of provocation via writing, speech or news dissemination.
He said the police would arrest and press charges against any individual who commits wrongdoing based on the existing provisions of the law. - Mkini
