Hospital Running As Usual After Auction

Hospital Islam Az-Zahrah in Seksyen 9, Bandar Baru Bangi. -- NSTP FILEPICBANGI: Hospital Islam Az-Zahrah, owned by Medi-Circle Sdn Bhd, will operate as usual even though RM200,000 worth of assets were auctioned off yesterday for failure to settle a medical negligence suit.
The hospital's legal team said this when asked to comment on the auction at the hospital premises in Bangi.
Medi-Circle had failed to pay RM8.32 million in damages, resulting in the seizure and sale of more than 150 assets, including two vans, medical equipment, office furniture, computers, cabinets, television sets, air-conditioners and sofa sets.
The public auction started at 10am, as ordered by senior assistant registrar Qasiratul Jannah Usmani Othman.
Medi-Circle made a last-ditch attempt on July 31 to set aside the writ of seizure and sale.
Despite the auction, the judgment sum still remains unpaid.
Present were the legal team of the family involved in the suit, Medi-Circle managing director Abdul Rahman Mt Dali, Hospital Islam Az-Zahrah chief executive officer Dr Ahmad Syukri Jamaludin and director Ali Karimi Abdul Rahman, the court-appointed auctioneer, five court-appointed security personnel and bailiffs.
The suit was filed by the family of a baby girl who was born at 26 weeks gestation on Feb 26, 2003.
She was later diagnosed with spastic quadriplegic cerebral palsy.
On Sept 10, 2020, the High Court found the hospital liable for the baby girl's condition, a decision that was upheld by the Court of Appeal and Federal Court.
Medi-Circle was issued a writ of seizure and sale over the non-payment in the suit.
On July 13, the hospital said the incident occurred under its former management and that a new management was running the hospital.
It said the previous management was working to settle the outstanding judgment sum and that there was an ongoing legal process.
The hospital said it would challenge the seizure process initiated by the plaintiff's lawyer due to errors in the process. - NST
