Govt Gets 2 More Weeks To File Defence In Medical Negligence Suit

Vimal Raj has been left disabled after several operations carried out at a government hospital.KUALA LUMPUR: The High Court has given the government two more weeks to file its defence in a medical negligence suit filed by a man on behalf of his teenage son whose limbs were amputated after several operations.
Lawyer Harwinder Kaur, who appeared for J Krishnasamy, said judge Ahmad Bache allowed the application made by senior federal counsel Anisah Normah Muhammad .
Harwinder said she did not object to the application.
“The defence now has to be filed on or before Feb 2,” she said after case management in a virtual hearing before Ahmad. The next case management is on Feb 4.
On Jan 8, the judge had ordered the defendants – the health ministry, Ampang Hospital, three doctors and the government – to file the defence by today.
Ahmad also ordered them to provide Krishnasamy with reports, notes, records and consent forms within 14 days after he allowed an application for discovery of documents to help the plaintiff prove his claim.
In his statement of claim filed last month, Krishnasamy said his son, Vimal Raj, had his left hand below the elbow amputated, right leg below the knee cut off and the left heel and toes severed in 201. He claimed this was due to the doctors’ negligence and breaches.
He is asking for special, aggravated, exemplary and general damages.
Krishnasamy said Vimal was a normal child without any critical illnesses or genetic issues, except for having an allergic reaction in his genital area before his admission to the hospital.
He was only diagnosed as suffering from “balanitis”, which is said to be a treatable condition that commonly happens in uncircumcised males.
The father said the surgeries were conducted between March 15 and Nov 26, 2019, causing Vimal to suffer severe disabilities. - FMT
