Federal Court To Decide On Monday Appeal By Ex Staff Of Former Selangor Mb
The Federal Court will decide on Monday the appeal by former staff members of former Selangor Menteri Besar Khalid Ibrahim who were sued by Selangor Menteri Besar Incorporated (MBI) over the recovery of alleged unauthorised payments.
New Sin Yew, one of the counsels representing the former staff, and lawyer Edwin Lim who acted on behalf of MBI, when contacted, confirmed the matter.
New said the decision would be delivered via Zoom.
On Jan 6, this year, the Federal Court five-member bench led by Court of Appeal President Rohana Yusuf reserved the court’s decision after hearing submissions from parties.
Former MBI CEO Faekah Husin and former chief operating officer Rohany Talib were ordered by the Court of Appeal in 2018 to return RM1.219 million to MBI which was paid to them as compensation.
MBI also named six other former officers of Khalid (above) as respondents in its lawsuit but the Court of Appeal made no orders against them.
They are Arfa’eza Abdul Aziz, Mustapha Mohd Talib, Rahimah Kamarudin, Dr Sulaiman Masri, Abdul Halim Mohamed Yusof, and Tuan Nazuri Tuan Ismail.
However, all seven of them who were represented by lawyer Edmund Bon Tai Soon are appealing against the Court of Appeal’s decision.
The Shah Alam High Court in 2017 ruled that the compensation paid out to the seven of them was valid.
The Court of Appeal reversed the decision, ruling that the decision by the Menteri Besar in his capacity as the chairperson of MBI must be with the approval of the board of directors.
MBI filed the suit in May 2015 against the seven of them to reclaim the money paid to them via a voluntary separation scheme (VSS) in 2014.
