Graphic artist and activist Fahmi Reza was charged in February with insulting former health minister Dr Adham Baba on Twitter.PETALING JAYA: Graphic artist and activist Fahmi Reza, who was charged in February with insulting former health minister Dr Adham Baba on Twitter, has been given a discharge not amounting to an acquittal (DNAA).
Fahmi’s lawyer, Rajsurian Pillai, said judge Nor Hasniah Ab Razak made the ruling at the Kuala Lumpur cyber crime sessions court this morning.
“(He was given a DNAA) based on the defence’s preliminary objections,” Rajsurian told FMT.
In a Facebook post following the court’s ruling, Fahmi said the judge agreed with the defence’s preliminary objections and dismissed the charges as flawed, adding that the bail money will be returned.

“Salute and thank you to the team of lawyers who handled my case for this small success. All of them took on this case on a pro bono basis without accepting any payments,” he said.
On Feb 10, Fahmi claimed trial to insulting Adham. He was charged under Section 233(1)(a) of the Communications and Multimedia Act (CMA), with the prosecution contending that he uploaded the post on Feb 10, 2021 with the intention to annoy others.
The tweet in question touches on the 2021 Cabinet policy that allowed ministers to observe a three-day quarantine, instead of 10 days, after they returned from overseas.
Adham was the health minister from March 2020 to August 2021. He is currently the science, technology and innovation minister.
Fahmi was also charged on Feb 17 under the same provision with insulting PAS on Facebook by linking the party with a picture showing beer. - FMT
