Ex Perak Rep Jailed 10 Months For Molest Of Underage Daughter
A former Perak assemblyperson is now serving a 10-month jail sentence for outrage of modesty of his then 12-year-old daughter in 2015.
A three-person Court of Appeal bench today, led by judge Hanipah Farikullah, partly allowed the prosecution’s appeal to restore the custodial sentence over the offence committed against the victim.
When contacted this afternoon, deputy public prosecutor Atiqah Abdul Karim confirmed the outcome of proceedings, which was also presided by judges Ahmad Nasfy Yasin and Hashim Hazmah.
The Court of Appeal restored the jail sentence meted out against the former BN state lawmaker by the Sessions Court two years ago.
The bench also overturned the RM5,000 fine meted out by the High Court against the 73-year-old accused last year.
The convict cannot be named to protect the identity of the victim.
Happened while victim was warded
According to the facts of the case, he perpetrated the offence against the victim while she was warded for an ailment at a hospital in Taiping, around 6pm on April 15, 2015. He was visiting her at the time.
After being discharged, the girl confided in her family about the matter. A police report was then lodged two days after the incident.
At the end of the accused’s trial, the Sessions Court imposed a 10-month jail term and RM3,500 fine.
The lower court also ordered him to serve an additional six months in jail if he failed to pay the fine.
On appeal, the High Court quashed the custodial sentence and increased the fine to RM5,000.
The High Court also ordered the accused to issue a written apology to the victim as well as his wife, who has since divorced him. He abided by this order. - Mkini
