Election Court Sets Dec 28 To Rule On Warisan Rep S Preliminary Objection
Warisan’s Yusof Yacob won the Sindumin seat with a 424-vote majority in the Sabah polls on Sept 26.KOTA KINABALU: Warisan’s Sindumin assemblyman Yusof Yacob will know on Dec 28 whether his preliminary objection to strike out an election petition filed to nullify his victory over the seat is successful.
The petition was previously made by Barisan Nasional candidate Sani Miasin who lost in a six-way contest for the seat to Yusof by a 424-vote majority in the 16th Sabah election in September.
High Court Judge Alwi Abdul Wahab had on Monday fixed the date to deliver the ruling after hearing submissions on the preliminary objection via video conferencing.
Sani had named Yusof, the returning officer and the Election Commission (EC) as the first, second and third respondents in his petition. The second and third respondents had also submitted their respective preliminary objections against the petition.
The BN candidate is challenging Yusof’s victory for the seat, contending that the latter was not duly elected as the Sindumin assemblyman.
Sani is also seeking that the outcome of the election on Sept 26 be declared void.
Alwi had on Nov 8 ordered all the respondents to submit their formal notice of preliminary objections through e-filing as well as their submissions.
Yusof, who is also Warisan information chief, had won the Sindumin seat after garnering 5,415 votes against Sani’s 4,991 votes in the election on Sept 26.
Yusof was represented by counsel Serena Liew while Sani by a team of lawyers comprising Rizwandean M Borhan, Mohd Azhier Farhan Arisin, Noor Azah Rahman and Al Hafidz Lokman. - FMT
