Deputy public prosecutor Kevin Morais’s body was found in an oil drum filled with cement in Subang Jaya in 2015.PETALING JAYA: The Ipoh High Court has granted a citation to the brother of murdered deputy public prosecutor Kevin Morais, allowing him to challenge a will purportedly drawn-up in 2005.
Lawyer T Dheenish, who represented Kevin’s younger brother Richard, said the ex-parte application was granted by registrar Nazratul Natrah Yusuf.
“Following the order, the executor (S Raam Kumar) will have to surrender the grant of probate to the court which issued the document within 14 days from today,” he told FMT.
Dheenish said a copy of the court order had been served on Raam Kumar, a lawyer in Ipoh, today.
Dheenish said Richard would now proceed to file a suit within the next few days.
“My client is contending that the grant of probate issued by the court in December 2022 is not correct,” he said.
Dheenish said the original will was not surrendered to the court to obtain the probate but that only a copy was given.
In the will, Kevin had named Raam Kumar, Richard and his brother David as beneficiaries of the estate.
The lawyer said all movable and immovable assets in Malaysia had been distributed to the beneficiaries except for property in the United Kingdom.
Kevin, 55, was reported missing on Sept 4, 2015, and was last seen leaving his apartment at Menara Duta in Kuala Lumpur in his official car. His body was found in an oil drum filled with cement in Subang Jaya 12 days later.
The Court of Appeal upheld the death penalty for six people, including a former military doctor, convicted of the murder that took place somewhere between Sentul, Kuala Lumpur, and Subang Jaya, Selangor. - FMT
