Another Music Industry Body Given Leave To Challenge Copyright Guidelines

(Reuters pic)KUALA LUMPUR: The High Court has today granted Music Authors Copyright Protection (MACP) Bhd leave to bring judicial review proceedings to challenge a new regulatory framework which is slated to come into force early next year
Justice Amarjeet Singh granted leave to MACP, a collective management organisation (CMO) representing music authors in Malaysia, to proceed with judicial review proceedings to quash the 2025 Copyright (Collective Management Organisations) Guidelines.
Lawyer Ong Yu Jian, who represented MACP, said the court was satisfied that the applicant had crossed the threshold for leave.
MACP had named the Controller of Copyright, the Malaysian Intellectual Property Corporation (MyIPO) as well as the domestic trade and cost of living minister as respondents.
Lawyer Nurul Hanani Azamuddin also appeared with Ong.
Amarjeet fixed Aug 19 to hear MACP’s application to stay the enforcement of the guidelines pending the disposal of the lawsuit.
MACP claims the guidelines were drawn up and issued by the respondents without proper consultation.
They said they were only provided a public consultation paper last year that outlined general proposals, without the specific details necessary for meaningful feedback.
MACP further claims that the guidelines contained “sweeping provisions” relating to the internal structure, constitution and governance of a CMO, its agreement with constituent members, and the terms of the licensing scheme to be implemented, matters which are ultra vires the powers of the Controller of Copyright.
Last week, Amarjeet had also granted leave to two other CMOs, Public Performance Malaysia Bhd and Recording Performers Malaysia Bhd, to pursue judicial review proceedings over the same guidelines. - FMT
