Trouble At Kl Tower Fahmi Fadzil Government And Lim Seong Hai Capital Subsidiary Sued For Rm1 Billion

Kuala Lumpur, March 29, 2025 – The long-time operator of Malaysia’s iconic KL Tower, Menara Kuala Lumpur Sdn Bhd (MKLSB), and its parent company, Hydroshoppe Sdn Bhd, have filed a lawsuit seeking RM1 billion in damages over what they claim to be an unlawful attempt to take over the concession to manage the landmark.
For nearly three decades, MKLSB has overseen the management and maintenance of KL Tower, one of the country’s most recognizable symbols of modern Malaysia. In 2022, MKLSB’s parent company, Hydroshoppe, entered into a strategic partnership with the Ministry of Communications Malaysia (KKM), aimed at improving the tower’s operations following financial challenges. This partnership was based on assurances that MKLSB would be granted a renewed concession to manage KL Tower, enabling Hydroshoppe to commit significant financial resources to revamp the tower’s infrastructure and improve its maintenance based on a government-backed Value Management Lab (VM Lab) report.
However, following Malaysia’s 15th General Election (GE15) in late 2022 and the subsequent change of government, KKM, now headed by Minister Fahmi Fadzil, awarded the concession to a subsidiary of Lim Seong Hai Capital Bhd, reportedly without honoring the prior commitments made to MKLSB and Hydroshoppe.
Hydroshoppe alleges that despite multiple efforts to resolve the issue amicably, KKM and the new concessionaire have refused to recognize the 2022 agreement, leaving the company facing severe financial losses and operational uncertainty. Adding to their woes, Hydroshoppe claims that RM25 million in outstanding payments owed by KKM for maintenance and operational services remains unpaid, further straining their finances.
In response, MKLSB and Hydroshoppe filed a lawsuit on March 27, 2025, naming Minister Fahmi Fadzil, KKM, and the new concessionaire as defendants. The lawsuit aims to challenge what they describe as a breach of the 2022 agreement and seeks compensation for losses incurred.
The following day, on March 28, 2025, MKLSB and Hydroshoppe filed an injunction application in the Kuala Lumpur High Court, seeking to prevent KKM from forcibly transferring control of KL Tower to the new concessionaire until the court fully resolves the matter.
The legal dispute has also sparked concerns over the welfare of MKLSB employees. According to the plaintiffs, many workers have been offered new employment terms by the incoming concessionaire that allegedly violate Malaysia’s labour laws, raising fears of job insecurity and unfair working conditions.
Given KL Tower’s status as a key national landmark and a major tourist attraction, MKLSB and Hydroshoppe are calling for a fair resolution that upholds the commitments made in 2022 and protects the stability of KL Tower’s management.
The case is now under the purview of the Kuala Lumpur High Court, and the outcome of the injunction application is expected to have significant implications, not just for the future management of KL Tower, but also for broader issues related to government contract enforcement and public-private partnerships in Malaysia.
The legal battle will be closely watched in the weeks to come as stakeholders await the court’s next decision.
