Senior Minister Obtains Court Order Against Ex Bersatu Women Chief
Senior Minister (Security) Ismail Sabri Yaakob has obtained a court order for former Bersatu women's chief Anina Saadudin to take down alleged defamatory online postings.
The plaintiff was granted the interim injunction by the Kuala Lumpur High Court this afternoon.
It was reported today that Ismail, in his personal capacity, filed a defamation suit against Anina over Facebook posts and videos alleging he was incompetent in discharging his duty during the movement control order (MCO) period.
The 61-year-old Umno veteran, through legal firm Messrs Kesavan, filed the lawsuit on March 5, naming Anina, 46, as the defendant.
Ismail's lawyer Ragunath Kesavan today confirmed that judge Mohd Firuz Jaffril allowed the ex-parte injunction application.
He said the court also fixed March 25 for case management of the matter.
An ex-parte proceeding is when only one party in the matter is present to submit before the court.
According to the provisions of the Rules of Court 2012, any ex-parte injunction order will only last 21 days from the date it is granted.
However, under common legal practice, parties would usually seek to fix a court hearing date for an inter-partes injunction order within that 21-day period.
An inter-partes proceeding is where both the plaintiff and defendant would submit before the court.
If the court allows the plaintiff’s inter-partes injunction application, then the restraining order against the defendant would continue until the disposal of the main legal action.
In his statement of claim, Ismail alleged that Anina posted 13 defamatory remarks and uploaded a video on her Facebook page.
The plaintiff claimed the online postings accused the minister of being incompetent in discharging his duties and implementing strict regulations to combat Covid-19 under the MCO.
He alleged that the 13 remarks, allegedly made by Anina between Feb 5 and March 3, were also shared by other Facebook users.
Ismail claimed that the remarks implied he was just a "puppet” in implementing the prime minister’s orders, and that he was an inefficient and incompetent senior minister. - Mkini
