Pm S Explanation Of Sabah Revenue Appeal Confusing Pkr Mp
PKR MP Hassan Abdul Karim said Prime Minister Anwar Ibrahim’s justification in only filing an appeal over parts of the High Court’s Sabah revenue judgment was confusing.
While he welcomed his party chief’s transparency, Hassan said Anwar cannot say the cabinet only agreed with the 40 percent revenue entitled to Sabah but disagreed with certain remarks made by the judge.
“We must understand that the judge’s verdict and the court judgment produced by the same judge are tied to one another.
“If the federal government is unhappy with the High Court’s verdict, then Putrajaya must file an appeal at the Court of Appeal (over the full judgment),” he said on Facebook today.
ADSEarlier today, Anwar reiterated at the Dewan Rakyat that the federal government will only appeal the Kota Kinabalu High Court’s ruling that claimed Putrajaya and the Sabah government had made major mistakes since 1974.
He stressed that this will not affect the ruling over Sabah’s entitlement to a 40 percent share of federal revenue collected from the state.

Confused cabinet, sloppy AGC
However, Hassan said Anwar’s explanation only revealed how the cabinet is confused on the matter, with the Attorney-General’s Chambers (AGC) failing to advise the executive branch accordingly.
The Pasir Gudang lawmaker also said that the 40 percent entitlement issue is a constitutional matter and the best platform to resolve it is the Federal Court, not the High Court.
The maverick MP stressed that if Putrajaya does not file an appeal, it means the federal government must abide by the High Court verdict in toto.
“And the federal government must execute what was decided by the High Court if they are not appealing. You cannot delay it by saying you will negotiate it with the Sabah government.
“Failing to execute it would be tantamount to contempt of court. This is what happens when you make hasty decisions.
“So, don’t blame anyone if they feel the federal government has erred in this,” Hassan added. - Mkini
