Pm Obtains Court Order For Lokman To Take Down Fb Post

The Kuala Lumpur High Court has issued an order for former Umno supreme council member Lokman Noor Adam to take down his Facebook post regarding Prime Minister Ismail Sabri Yaakob.
Ismail Sabri’s counsel Ragunath Kesavan confirmed with Malaysiakini that judicial commissioner Roz Mawar Rozain allowed the ex-parte injunction application for the removal of the online social media posting dated Aug 22.
The injunction was sought to maintain the status quo between plaintiff Ismail Sabri (above, left) and defendant Lokman (above, right) pending disposal of the latter’s main defamation civil action against his fellow party member.
The main civil action is over the Aug 22 posting that allegedly contained allegations over Ismail Sabri purportedly meeting former prime minister Dr Mahathir Mohamad.
Under the law, an ex-parte application is one that is done with the presence of only one party without that of the opposing side.
Ragunath told Malaysiakini that the court allowed Ismail Sabri’s application for Lokman to take down the posting from his accounts on Facebook, YouTube, Instagram, and TikTok.
The lawyer added that Roz Mawar has also set Sept 26 at 3pm for an inter-partes hearing for the injunction.
Under the law, an inter-partes hearing is where both sides, in this case, Ismail Sabri and Lokman’s legal team, would be present to present submissions on whether the court should allow the injunction, pending disposal of the main civil action.
On Sept 1, before the Kuala Lumpur Sessions Court (criminal jurisdiction), Lokman pleaded not guilty to two counts of making offensive communications against Ismail Sabri and the government.
Lokman was accused of making the remarks on Facebook, one on Aug 20 and the other on Aug 22, with the intent of annoying others.
Both charges were framed under Section 233(1)(a) of the Communications and Multimedia Act.
According to the charge sheets, the offending remarks were made in videos where Lokman allegedly scolded Ismail Sabri and the government over their handling of former prime minister Najib Abdul Razak's final appeal of the SRC International case.
Bernama reported that the prosecution asked for bail to be set at RM15,000 for each charge.
However, Lokman's lawyer asked for RM2,000 bail for each charge on the grounds that the Umno man - who now works as a satay seller - does not have a stable income and has 11 children of schooling age to look after.
Sessions Court judge Nor Hasniah Abd Razak set bail at RM8,000 for each charge and issued a gag order against Lokman from commenting on the case on social media. - Mkini
