Man Who Struck Housemate With Rice Cooker Gets Reprieve
Labourer Jobi Ullah was sentenced to 13 years in prison.PUTRAJAYA: A Bangladesh national, who was initially sentenced to death for killing his housemate, had his charge reduced to culpable homicide by the Federal Court.
Jobi Ullah, 44, was sentenced to 13 years in prison by a three-man panel after he pleaded guilty to a charge of committing culpable homicide not amounting to murder of his friend and housemate Minto.
The panel – comprising Court of Appeal president Abang Iskandar Abang Hashim, and Justices Mary Lim and Abu Bakar Jais – ordered Jobi to serve his sentence from March 28, 2018, the date he was arrested.
In delivering the court’s decision, Abang Iskandar set aside the death sentence, which had been handed down for the murder charge.
Earlier, court-assigned counsel K Simon Murali informed the court that the prosecution accepted his client’s representation and this was confirmed by deputy public prosecutor Fairuz Johari.
On June 29, 2020, the High Court sentenced Jobi to death after finding him guilty of killing Minto, also from Bangladesh at a house in Jalan Megat Harun, Taman Jasa, Bukit Mertajam, Penang, at 11.15am on Sept 25, 2018.
According to the facts of the case, the two got into a fight in the kitchen because Minto’s pots obstructed the kitchen cabinet.
Jobi, a labourer, struck Minto across the head with a curry pot and a rice cooker. Minto was then taken to hospital, suffering internal head injuries and died on March 28, 2018.
Murali said his client was remorseful and had visited the deceased at the hospital to seek forgiveness.
He asked the court to impose a sentence of eight years saying the killing was not premeditated.
However, Fairuz said the proper sentence should be between 15 years and 20 years. - FMT
