Man Jailed 5 Months For Threatening Harith Iskander S Daughter
The Kuala Lumpur Magistrate’s Court has sentenced a man to five months in jail and a fine of RM2,000 for threatening death and rape against comedian Harith Iskander’s 12-year-old daughter.
Izzuddin Md Salim, 31, pleaded guilty when the criminal intimidation charge was read out to him before magistrate S Mageswary today.
“I am sorry,” the house repairer said while in the dock as Harith (above) and his ex-wife Jezamine Lim looked on from the public gallery.
Mageswary ordered the accused to serve another month in jail if he failed to pay the fine and to serve the five-month jail term from the date of arrest on Jan 24.
Izzuddin admitted to committing the offence by sending a WhatsApp message to Jezamine’s handphone on Jan 23 around 8.50am.
The accused admitted to sending a message which read “Hey, your daughter is looking *********, dark humour, are you scared of me, you dare make fun of some religions okay, then do not regret I am after your daughter, go report it to the nearest police station I am brave, you know who they are right? Police will protect you but not your daughter.”
While the charge and facts of the case were read out by the interpreter in court, the unmarried accused admitted that the message - containing a photo of Harith’s daughter - was sent to the complainant who was in a restaurant at Jalan Bunus 6, Kuala Lumpur.
He admitted that his action had amounted to criminal intimidation of Jezamine, 41.
The offence is punishable under Section 506 of the Penal Code, which carries a jail term of two years and a fine, or up to seven years if the alleged intimidation involves death threats.
‘I just wanted to play with Harith's feelings’
During the open-court proceedings, the unrepresented Izzuddin apologised for his actions.
Izzuddin: I was only intended to play with Harith's feelings (Saya hanya berniat untuk bermain dengan perasaan Harith sahaja). I apologise and seek a lesser sentence as this is my first offence. I promise not to repeat it forever.
Mageswary: Do you understand the content of the WhatsApp message?
Izzuddin: Yes.
Mageswary: You intentionally sent it?
Izzuddin: Yes, I only intended to play with feelings.
Mageswary: Is that how you play around? (Itu ke cara main-main kamu)
Izzuddin: I am sorry.
Mageswary: If it was your daughter then how?
Izzuddin: (I would have) Felt angry and scared.
The accused also admitted he used ChatGPT to generate the threatening message.
During the open-court proceedings, a lawyer from the National Legal Aid Foundation (YBGK) pleaded for Izzuddin to be given a lenient sentence as the accused had learnt his lesson while under remand and thus deserved a second chance.
However, deputy public prosecutor Mohd Sabri Othman sought a deterrent sentence to serve as a lesson not just to Izzuddin but also to others in society, due to the wide media coverage the case attracted.
When met by the media after proceedings to ask whether Harith and Jezamine accept the accused’s apology, the comedian said the apology was only made to the court.
Comforting Jezamine who was in tears, the comedian ruminated on how one can imagine a mother must feel over their daughter being threatened.
The police were investigating Harith, 54, over an alleged “ham” joke, and had submitted investigation papers to the Attorney-General’s Chambers (AGC).
The authorities had also recorded a statement from another suspect, a 64-year-old woman, who allegedly left a controversial comment on Harith’s Facebook account.
Police were investigating her over allegedly insulting Prophet Muhammad.
Previously, the authorities recorded Harith’s statement over a Facebook post and photo showing an RM5.50 coffee drink called “ham sap kopi”.
The alleged post came on the heels of the controversy surrounding the halal status of ham and cheese sandwiches. - Mkini
