Lenggong Pkr Branch Intact Despite Mass Committee Resignation Fuziah

PKR’s Lenggong branch remains intact despite the simultaneous resignation of 15 committee members, said party secretary-general Fuziah Salleh.
“The headquarters has received their resignations. I have also investigated the branch’s status.
“The branch’s status is not dissolved because it requires 21 committee members to resign before the branch can be dissolved,” she told Malaysiakini.
The resignations followed allegations of a lack of transparency and fairness in the branch election process and outcomes.
Earlier, one of the five candidates for Lenggong PKR branch chief, Ahmad Nizam Noh, said he had lodged a report with the Registrar of Societies (ROS) headquarters in Putrajaya on Thursday.
According to Nizam, nearly all committee candidates from his team won their contests, but he lost the bid for branch chief.
As a sign of protest, he said all 15 winning committee members from his team resigned immediately.
Two-thirds resignation needed
Under Clause 37.3 of the PKR constitution, a branch committee must consist of a chief, deputy chief, vice-chief, youth chief, women’s chief, and 15 committee members elected through the branch polls.
The branch chief may also appoint two vice-chiefs, a secretary, a treasurer, an information chief, and not fewer than five and not more than 20 additional committee members, bringing the maximum to 31 committee members.
Dissolving a branch committee requires at least two-thirds of its members, or 21 individuals, to resign simultaneously.
However, a Malaysiakini review found that the PKR constitution does not clearly define the appointment powers at the branch level.
Clause 38.2 states that the branch secretary must issue a meeting notice at least seven days before the meeting date. If the secretary fails, the party convening the meeting must issue the notice.
Clause 38.4 further stipulates that the quorum for a branch committee meeting is at least one-third of the total committee members.
No provision specifically details the branch chief’s power to appoint committee members before the first meeting is held. - Mkini
