Kemaman Set For By Election As Pn Not Appealing Ge15 Results Nullification
Perikatan Nasional will not appeal the Kuala Terengganu Election Court nullification of the opposition coalition's victory in Kemaman during the 15th general election.
As a result, the Election Commission (EC) is set to later announce the parliamentary seat’s vacancy, paving the way for a by-election.
In a statement today, PAS secretary-general Takiyuddin Hassan announced that they will not appeal to the Federal Court against the Election Court verdict delivered on Sept 26.
"PAS has decided not to file any appeal against the Kuala Terengganu Election Court decision that allowed BN’s election petition against Kemaman MP Che Alias Hamid, thus nullifying PAS’ victory during GE15 on Nov 19, 2022," Takiyuddin said.
PAS made the decision after being informed that the Kemaman election petition verdict is the same as a previous Election Court ruling that nullified PN's GE15 victory in Kuala Terengganu, he added.
PAS secretary-general Takiyuddin HassanTakiyuddin said the Election Court's reasoning was that there had been elements of corruption during the electoral campaign, but no parties were named over the incident.
"Therefore, PAS awaits and is ready to take the next step based on what the EC will decide following the verdict."
Kemaman election petition
On Sept 26, High Court judge Anselm Charles Fernandis allowed an election petition by voter Wan Mohamad Hisham Wan Abdul Jalil over the Kemaman seat.
On Feb 13, the Election Court struck out the petition when it allowed Che Alias’ preliminary objection over the petition purportedly containing defective and invalid facts in support of bribery and corruption claims during GE15.
However, on May 2, the Federal Court allowed Wan Mohamad Hisham’s appeal to reinstate the petition for full trial before the lower court.
During GE15, Che Alias wrested Kemaman with a 27,179-vote majority, defeating BN candidate and former Terengganu menteri besar Ahmad Said, as well as Pakatan Harapan candidate Hasuni Sudin dan Pejuang’s Rosli Ab Ghani.
PAS’ Che Alias HamidOn June 27, the Election Court also nullified PAS member Ahmad Amzad Hashim’s victory in the Kuala Terengganu parliamentary seat in GE15.
However, following an ensuing by-election, Amzad defeated Harapan candidate Azan Ismail with a resounding 47,266-vote majority, securing 68,369 votes. Azan only garnered 21,103 votes.
Following GE15, PAS clinched 43 out of 222 parliamentary seats. However, with the Kemaman election results nullification, this leaves the Islamist party with 42 seats.
