Kajang Party Group Files For Revision Of 14 Day Sentence For Defying Mco




KUALA LUMPUR: A group of 17 people who gathered at a condominium unit during the movement control order (MCO) period has filed for a revision over their 14-day jail sentence by the Kajang Magistrate’s Court
Lawyer KA Ramu, who is representing the group, said the application to review the group’s sentence was filed on Thursday (April 9)
“The matter will be heard at the Shah Alam High Court on April 14, ” he told The Star on Friday (April 10)
He said the revision was filed on grounds that many previous cases were given community service and fine
On Wednesday (April 8), a Kajang Magistrate’s Court sentenced the group – aged from 22 to 34 – to 14 days' jail for flouting the MCO by gathering at a condominium unit
Magistrate Muhammad Noor Firdaus Rosli said the MCO was not a frivolous rule and ordered for the jail sentence to run from the date of arrest on April 3
Syafiq Asyraf Khan Gulab Khan, Muhammad Halim Md Yasin, Mohd Saddam Hussain, Amirul Asyraf Muzaffar, Aiman Firdauz Azri, Muhamad Riduwan Abd Razak, Afeeq Aiman Razman, Muhammad Shahmi Samsulnizam, Mohammad Afiq Mohammad Afifi, Nuur Tamiyah Mohamad Yusof, Muhammad Danial Ali Hussin, Mohd Syafiq Azri, Mohamad Akir Abdul Aziz, R. Brithibaaraj, Yan Naida Sakila Jaafar, Wan Nurhuda Wan Salam and Nur Sabrina Ihsan pleaded guilty after the charges were read out separately
They admitted to being present at an infected area without valid reasons at Kondominium Amerin, Taming Jaya, Kajang, at 12.35pm on April 3
The offence under Rule 6 of the Prevention and Control of Infectious Diseases (Measures Within the Infected Local Areas) Regulations 2020 carries a maximum RM1,000 fine and up to six months’ jail, or both, if convicted
According to the statement of facts, a team of policemen from the Ops Covid-19 task force received a complaint about a noise coming from a condo unit
The police found 19 people – 14 men and 5 women, including two minors – at the condominium unit
There were no illegal items found but the group failed to give a reason why they were not in their own homes and had therefore violated the MCO
The two 17-year-olds also pleaded guilty to the same charge
However, the court postponed their sentencing pending a report (laporan akhlak) from the Welfare Department on May 14
The minors were released on bail at RM500 in one surety each. - Star
