PETALING JAYA: The investigation paper on the beating of a mentally disabled man at the Padang Astaka Chukai farmers’ market in Kemaman, Terengganu, on Jan 17 was sent to the Attorney-General’s Chambers on Feb 5, say police.
Terengganu police chief Khairi Khairudin said the police had proposed two charges against the six suspects involved under Section 147 of the Penal Code for rioting and Section 323 of the same code for causing injury, Sinar Harian reported.
“We are still awaiting instructions as to whether the six suspects are to be charged.
“The AGC may need more time to look at the case from more angles before the suspects can be charged,” he was quoted as saying at a media conference at the Kemaman district police headquarters today.
Khairi also said the AGC had received the medical report on the victim from the health ministry.
On Jan 17, Ahmad Nor Al Faizan Jusoh, 47, was assaulted after his motorcycle smashed into a stall at the farmers’ market, causing several items from one of the stalls to topple to the ground.
He was dragged, kicked and beaten before the stall owner poured fried noodles over his head.
Previously, acting Kemaman police chief Wan Muhamad Wan Ja’afar said the investigation paper on the case had been referred to the AGC but was returned with a request for a detailed medical report on the victim.
Khairi said an investigation paper on a social media influencer who was arrested for allegedly uploading a threatening post related to the assault was also referred to the state deputy public prosecutor’s office two weeks ago.
“The paper is complete. We received a report from the Malaysian Communications and Multimedia Commission on the suspect’s TikTok account and are still awaiting a decision.
“We have proposed that the suspect be charged under Section 506 of the Penal Code for criminal intimidation, and Section 233 of the Communications and Multimedia Act 1998 (for improper use of network facilities or services),” he said. - FMT
