Gobind Presses Agc On Inmate S Uninvestigated Custodial Death

Digital Minister Gobind Singh Deo has called on the Attorney-General’s Chambers (AGC) to clarify allegations that the authorities failed to investigate the death of a prison inmate, nine months after the incident occurred.
He was responding to a recent Malaysiakini report detailing the case of Manisegaran Mohan, a 41-year-old lorry driver who allegedly died under suspicious circumstances after being detained at the Bandar Sunway police station in Petaling Jaya, earlier this year.
“I think it would be good for the AG to explain why there was no action taken (as of now), since they are the custodian of public interest,” he told reporters today.
Gobind, a senior lawyer, added that death under custody must be investigated, as stated under Section 334 of the Criminal Procedure Code.
“The law states that an investigation is required if a death occurs (during) police custody,” he said.
Manisegaran’s wife, Rajeswari Subramaniam, recently claimed that her husband had sustained injuries to his chest, had broken teeth, and was bleeding in his eyes.
Manisegaran MohanShe added that the post-mortem report allegedly offered conflicting explanations, including suggestions of a heart attack, drug use, and fluid in the lungs.
However, she said the death certificate merely stated that the cause of death was “pending further investigation”, which has made it difficult for the family to file insurance claims, as the police have yet to issue a final death certificate for this reason.
After nine months of waiting, Rajeswari appealed to Home Minister Saifuddin Nasution Ismail to intervene and help determine what really happened to her husband.
Durian Tunggal case
Gobind said that prompt action must also be taken in the case of the three men who were shot dead in Durian Tunggal, Malacca, on Nov 23.
According to media reports, police shot the men in an oil palm plantation over alleged links to armed robberies.
“We need an investigation to ensure that the law is followed and action is taken in accordance with the law.
“Transparency and clarity (from) the authorities are very important to ensure public confidence in the security and justice institutions,” he said, pointing out that a police report has been filed and an investigation team set up.
Malacca police chief Dzulkhairi Mukhtar said officers had opened fire after the suspects attacked a police officer with machetes, leaving him seriously injured.
However, families of the deceased disputed the police narrative, pointing to an audio clip in which the men appeared to be cooperating with officers during their arrest.
Their legal counsel, Rajesh Nagarajan, has also argued that the officers involved should face murder charges for the incident.
The case drew further attention after the federal police’s criminal investigation department (CID) director, M Kumar, visited the injured officer in hospital on Nov 25.
Kumar also announced that Bukit Aman would take over the investigation and pledged a transparent, fair and professional probe. - Mkini
