Court Sets Nov 5 To Decide On Logging Companies Application
The application for permanent inter-parte injunction filed by two logging companies against eight villagers who allegedly obstructed the extraction work of forest produce near Kampung Baharu, Jerantut, will be decided on Nov 5.
High Court judge Zainal Azman Ab Aziz set the date during mention proceedings today, and the matter was informed by lawyer Jacob Goldie, who is representing the two logging companies.
During the proceedings, the defendants were represented by counsel Charles Hector Fernandez.
Logging companies Beijing Million Sdn Bhd and Rosah Timber & Trading Sdn Bhd filed the application on July 14 after claiming that they were disturbed by the defendants’ action, who had obstructed the work and uploading inaccurate statements or pictures on the plaintiffs’ Facebook page.
The eight defendants are Mohamed Said, 62; Mohamed Zarrif Mahmud, 29; Mohamad Hafizi Rosnan, 30; Saifulnizam Sulaiman, 33; Sukmarizal Nazman, 27; Shukran Firdaus Nazman, 29; Mohammad Zakirin Hasan, 36; and Mohamad Lozi Mohd Nasir, 45.
The plaintiffs claimed to have obtained the right under one licence to extract forest produce in an area of 202.61 hectares in Compartment 1 of the Jerantut Forest Reserve from the Pahang Forestry Department on Jan 28, 2019, and scheduled to start work earlier this year.
The plaintiffs said they started making preparations by bringing machinery into the site on Feb 19, 2020 but was interrupted by the defendants until the workers had to leave the area and lodge a police report for personal safety.
The incident caused the Jerantut Forestry Office to issue a work suspension letter effective Feb 20 until the issue is resolved, which also causes the plaintiffs to incur losses.
