(AP pic)PETALING JAYA: The Kuala Lumpur High Court has allowed 1MDB and its four subsidiaries to serve a writ of summons for a US$3.78 billion (RM16.82 billion) claim on Low May Lin, the sister of fugitive businessman Low Taek Jho, also known as Jho Low, through substituted service.
Siva Kumar Kanagasabai, who is representing 1MDB in the lawsuit, said they will serve the writ of summons on May Lin via an advertisement in Singapore’s newspaper The Straits Times as she was believed to be residing in that country.
Siva Kumar was speaking to reporters after proceedings today before Justice Hayatul Akmal Aziz.
“The deputy registrar’s decision to deny our application to use substituted service on Oct 13 was set aside, and the application for substituted service was allowed,” he was quoted as saying by Bernama.

“Since personal service is impractical, we filed an application to use substituted service in line with the Rules of Court 2012,” he said.
Substituted service refers to the delivery of court documents by way of advertisement or any other means capable of bringing the proceedings to the defendant’s attention.  It is used when personal service cannot be effected.
According to Bernama, Siva Kumar said attempts to deliver the writ of summons to May Lin at her last known address in Singapore had failed.
He added that the writ of summons had, however, been delivered to Jho Low’s brother Taek Szen – who is believed to be residing in Hong Kong – and the other defendants.
Last year, 1MDB and its four subsidiaries filed a statement of claim seeking a total of US$3.78 billion against Jho Low, his father Larry Low Hock Peng and four other defendants: Jho Low’s mother Goh Gaik Ewe, his sister May Lin, his brother Taek Szen and his business associate Eric Tan Kim Loong.
Jho Low is facing criminal charges in Malaysia and in the US over allegations that he orchestrated the theft of US$4.5 billion from 1MDB.
He is believed to be in Macau or China, but Beijing has denied protecting the fugitive financier. - FMT
