Albert Seeks To Question Smm Ceo Over Contempt Allegations
The whistleblower in the Sabah mining scandal, Albert Tei, is seeking to question Sabah Mineral Management Sdn Bhd (SMM) CEO Nathasha Sim in court.
This is regarding Sim’s affidavit in support of SMM’s application to commence contempt proceedings against Tei (above) for allegedly breaching a court order, according to a copy of Tei’s application that is being circulated on social media.
Tei’s application sought to cross-examine Sim over her affidavit in an open court, with a hearing being fixed at the Kota Kinabalu High Court on Aug 28 to hear the application.
“It is necessary and in the interests of justice that (Tei) is granted leave to cross-examine the said deponent to clarify the insinuations, inherently improbable and/or false statements contained in (Sim’s affidavit).
ADS“The proposed cross-examination of the said deponent would advance the cause of justice as the affidavit evidence and/or available contemporaneous documents are insufficient to enable this court to determine conclusively the allegations of contempt against the applicant (Tei),” read the notice of application dated July 28.

Malaysiakini’s checks with court records found the document to be authentic.
When contacted yesterday, Tei’s lawyer, Chong Kian Ming, also confirmed the document’s authenticity but said he had no instruction to comment on it.
The court proceedings are part of SMM’s civil suit against its former CEO, Jontih Enggihon, and Tei.
SMM had filed the suit in January, alleging “fraud, breach of fiduciary duties and confidentiality, tampering with official documents, conspiracy to injure by unlawful means, and potential collusion with third parties”.
The proceedings are ongoing before judge Lim Hock Leng. - Mkini
