MACC chief commissioner Tan Sri Azam Baki said the anti-graft body had taken this stance for fear of being sub-judice. -NSTP file picKOTA BARU: The Malaysian Anti-Corruption Commission (MACC) will not issue another statement on its probe into Court of Appeal judge Datuk Mohd Nazlan Mohd Ghazali.
MACC chief commissioner Tan Sri Azam Baki said the anti-graft body had taken this stance for fear of being sub-judice.
"Whatever statement given by chief justice was her right. MACC will leave it to the court to decide the case and will not comment on the case again," he said after an investiture held in conjunction with Kelantan sultan's birthday here today.
Chief Justice Tun Tengku Maimun Tuan Mat on Thursday said the MACC media statement on its investigation of Nazlan has harmed public trust in the judicial system.
Tengku Maimun, who led a seven-member Federal Court bench, said this when hearing an application to refer two constitutional questions relating to the MACC's investigation into Nazlan.

- Whether criminal investigation bodies, including the MACC, are permitted to investigate High Court, Court of Appeal and Federal Court judges only after they have been suspended under Article 125 (5) of the Federal Constitution (FC).
- Whether the public prosecutor is empowered to institute or conduct any proceedings for an offence against serving judges pursuant to Article 145 (3) of the Federal Constitution.
Nazlan presided over the High Court that convicted and sentenced former prime minister Datuk Seri Najib Razak to 12 years' jail and RM210 million fine for misappropriating RM42 million of SRC International Bhd funds. - NST
