Bersatu Files For Dismissal Of Suhaili S Lawsuit

KUALA LUMPUR: Bersatu has filed to dismiss the lawsuit brought by Labuan MP Suhaili Abdul Rahman, who is seeking a declaration that his expulsion from the party was invalid and illegal.
Bersatu, represented by Suhaimi Yahya, filed the application at the Shah Alam High Court through Chetan Jethwani & Company yesterday.
The party claims the court does not have jurisdiction to determine the core issue brought by Suhaili, 63, under Section 18C of the Societies Act 1966.
Bersatu also claims that Suhaili lacks the legal standing to bring the action because he is no longer a party member.
The plaintiff’s claim is frivolous, vexatious and an abuse of the court process to achieve a hidden motive, Bersatu said in the application.
Suhaili, who filed the lawsuit on July 1, said that on Nov 2, 2023, the Bersatu disciplinary board issued a letter informing him of the charges against him for allegedly violating Article 22.1 (f) of the party’s constitution.
He said the letter informed him that a report had been made regarding his press statement supporting Prime Minister Anwar Ibrahim.
Suhaili said that on Nov 3, 2023, he wrote a letter to the board explaining that the statement was made due to the party’s failure to provide funds to help the people of Labuan.
He claimed that despite providing a reasonable explanation, the board illegally and irrationally decided to suspend his membership for six years on Nov 7, 2023.
Subsequently, Suhaili said he sued the party through Bersatu secretary-general Hamzah Zainudin in the Kota Kinabalu High Court on Dec 19, 2023, but the case was dismissed after the court decided it had to be filed in the peninsula.
On May 17, Suhaili claimed to have received a letter from Hamzah informing him that he was automatically expelled for filing a lawsuit against the party based on Article 10.2.6 of the party’s constitution. - FMT
